1. About these terms

These Terms & Conditions govern your use of Deliny Insights (the "Service"), operated by DelinyInsights ("we", "us", "our"). By creating an account, accessing, or using the Service you agree to be bound by these terms. If you do not agree, do not use the Service.

2. The Service

Deliny Insights provides a hosted link-in-bio, media kit, broadcasts, and analytics platform for coaches and creators. Features available depend on the plan you choose.

3. Account & accuracy

You must be of legal age (or have authority to bind your organization) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account. You agree to provide accurate information and keep it up to date.

4. Acceptable use

You agree not to misuse the Service. In particular you must not:

• use the Service for unlawful, fraudulent, or harmful activity, or to send spam;
• infringe the intellectual property or other rights of any person;
• upload malware, attempt to probe, scan, or breach security, or scrape the Service;
• reverse engineer, resell, or circumvent technical limits of the Service.

5. Intellectual property

We retain all rights, title and interest in the Service, including its software, design, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscribed plan. You retain ownership of the content you upload; you grant us a limited license to host and process that content solely to provide the Service.

6. Payments, subscriptions & taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. Subscriptions renew automatically at the cadence shown at checkout until cancelled.

7. Service level & warranties

The Service is provided "as is". We do not guarantee that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, special or punitive damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

9. Indemnity

You agree to indemnify us against any claim arising from content you upload, your unlawful use of the Service, or your breach of these terms.

10. Suspension & termination

We may suspend or terminate your access for material breach of these terms, non-payment, fraud or security risk, or repeated policy violations. You may cancel at any time from your billing settings. Upon termination, your right to use the Service ends and we may delete your data after a reasonable export window.

11. Governing law

These terms are governed by the laws applicable at the operator's place of business. Disputes shall be brought before the competent courts of that jurisdiction, unless mandatory consumer law in your country of residence applies.

12. Changes

We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
